Legal Question in Credit and Debt Law in California
collections
I have been sent to an outside collection agency for my B of A Visa card. I have a $9000.00 balance and they are trying to serve me papers at home. They said I have been sent to 'arbitration'. I am a 10-99 worker earning peanuts and cannot afford to settle or pay them anything. I rent my home. Can they attach my wages as a 10-99? Can they go after my wife's wages if she is not the primary card holder? Do I have to open a new checking account to stay ahead of the levy if I loose a judgment? Is it possible to dodge this bullet. I am behind in all my bills and don't know what to do.

You may have valid defenses such as the statute of limitation. Also, there may be a violation of the Fair Debt Collection Act. Please contact us if you have any questions.
