Legal Question in Credit and Debt Law in California

I have a borrower trying to re-fi their home. They have some unpaid collections that are credit card debt. I have been told that if the original creditor is still holding the debt, that creditor can go for a judment. If the debt has been sold off to a collection agency, the collection agency cannot go for a judgment. Is this correct?
