Legal Question in Credit and Debt Law in California

Condo Foreclosure re:Association Dues

Can my homeowners association and the debt collection co. they hired (Allied Trustee) force me into foreclosure because I got behind on my dues? You should know: I have written to them and received no reply. I have requested a statement from our management co. - and received no reply: I have made double payments, I've suggested a payment plan, AND I have been making payments. Only, now, since July, they return my double and triple payment of the dues - insisting I need to come up with a lump sum. (Of course half of what they say I owe is to Allied Trustee.)

Can you help? I don't want to lose my home, and I can't come up with the lump sum they are demanding.

Re: Condo Foreclosure re:Association Dues

The short answer is yes. Under certain circumstances, a homeowners association can file a lien against your home then foreclose on the lien if you fail to pay your association dues.
