Legal Question in Credit and Debt Law in California
corporate card dilemma
My husband's exemployer has charged $6,000. on my husband's corporate card and has not paid him (wages for 5 paychecks)or his charge card in over 100 days. My husband did charge $200. in work related items. The other purchases were not his and the credit card company is calling us daily. The credit card company has not given us a summary of purchases and they have been of no help. The credit card co. says they will file a deliquent credit report at 120 days if we don't pay his employer's credit card balance. (my husband is in construction.)

Re: corporate card dilemma
Thank you for your inquiry.
In my opinion, you should look in the white pages of your phone book, find the labor board office nearest to you, and file a wage claim immediately. Employees have the right to be reimbursed by law, and especially paid for work performed within certain time limits, and employers that do not do so
The charge card amounts are reimbursable, and the labor board can order those payable to you. You can also sue the company for reimbursement, and all damages to your credit, but I believe you will find that a labor board hearing, which includes the possibility of double and triple damages against the employer, would be the quickest and cheapest way to resolve this in your favor.
Best of luck.
Re: corporate card dilemma
It is important that you create a written record of your complaint by writing a detailed letter to the employer which demands a resolution. Once you have done this and there is no satisfactory result, you may proceed to file complaints with the labor board and/or the state contractor's licensing board.
