Legal Question in Credit and Debt Law in California
Co-signer repo'ing ex-boyfriend's car
I cosigned for a car for my exboyfriend and father of my son. Once we broke up he has tried various ways to control me, including withholding car payments for the car he was driving. He paid some car payments in cash and missed some payments and tried to say that he paid other payments that he didn't make, making comments about me not being able to prove he didn't pay. He also knows I am protective of my credit and knows I will make the payments myself rather than take a hit on my credit report. I warned him before he was 2 payments behind that I would have the car reposessed, and did. Now he is saying he has the money to make the payments and begging to have the car back, but I don't want to continue this painful process. What are my best choices to get out of this arrangement, sell the car or ..? He is also insinuating I had no right to take the car. The title is in both our names, (my name) ''or'' (his name.)

Re: Co-signer repo'ing ex-boyfriend's car
Good for you to have repoed the car. You can hang onto the car, or you can sell it at a fair sale and sue him for any difference between what you get at the sale and what is owed on the car.
