Legal Question in Credit and Debt Law in California

Court summons from unknown creditor

Yesterday I recieved a summons to appear from an unknown creditor. I am being sued for 1100.00 by Platinum Financial Services for credit card charges. I have no idea who this company is and I have not gotten a credit card in California before. This is really strange, I even tried to call and I just get an answering machine plus I cant find them anywhere on the website. I am due in court Feb 17, 2004. I am cleaning my credit up and I have not added any new debt. This is extremely strange. Any suggestions?

Re: Court summons from unknown creditor

I think you are a little confused. If you were served with a Summons and Complaint you have thirty days to "appear" in the case, that is, to file an answer or a demurrer. After you have denied the allegations of the complaint and probably cross complained for fraud, you will have time to do some discovery, such as demanding a Bill of Particulars, which requires the plaintiff to list the obligations they are basing their suit upon. That ought to give you a better idea of what this is all about.

You will have to answer the complaint and do discovery in order to succeed in this case if th creditor is unknown. Please contact our office for review of the lawsuit and for consultation.
