Mr former spouse did not have her names changed to mine during our marriage. After the divorce it was stipulated that she would take back her maiden name. I suspect the she has recently used my last name in a credit application. What are my rights? Is this fraudulent?

Your question is confusing. You state that your former spouse never had her name changed to yours during the marriage but after the divorce she stipulated to take back her maiden name. So what name did she use during the marriage? Using an alias in a credit application might be considered fraudulent if her intent was to receive goods and/or services without paying for them. I don't see how her using your name would affect your credit and/or rights, unless she was trying to pass herself off as you. Is this a same sex marriage?
