Legal Question in Credit and Debt Law in California

Using a credit card not my own

I used my brothers credit card after he died in 1990. My name is not on the account. I charged about $1,000 and I have been making the payments regularly every month. I have not used the card since 1992. I can no longer afford to make these payments and the balance has only gone from 5,000 to 3,000 in all that time. Please advise me what to do to end this situation.

The statute of limitations on criminal fraud has probably already run so don�t use the card again. They could still sue you for civil fraud depending on when and how they discover it. If they know it was you using the card you should probably contact them and make some payment arrangements you can afford. if they don�t know its you another option is to just ignore it and let them spin their wheels looking for your brother.
