Legal Question in Credit and Debt Law in California
Credit Card Company Identity Theft Questions
For the last 4 months, I have been dealing with a credit card company involving an account that has over $12,000 worth of changes that I did not do. At first the said there was no problem - that it was not my responsibility. As the months went forward, they started to state that I was responsible, and that they had transactions to prove it.
I have requested over and over that they send me copies of the statements so I can see exactly what transactions have been posted. As of this date I have not received any statements.
Today I received a call from them stating that my roommate is responsible (which I know is not true). They stated that I should call the police on him, and If I don't, they will call the police on me and have me arrested. From researching the California civil code, the state Rosenthal Fair Debt Collection Practices Act and the federal Fair Debt Collection Practices Act states that ''They may not harass you by using threats of violence or arrest or by using obscene language.'' It appears to me that is exactly what they are doing.
Any help or advice would be greatly appreciated!
Thanks!
