Is it legal for a business to charge a convenience fee if a customer is using a credit card to pay by phone?

There is no law that prevents it that I am aware of, however, the business has an agreement with their Mastercard, Visa, etc... merchant account provider which in most cases provides that they cannot charge a "convenience fee" for use of a credit card. Threaten to contact MC and Visa if they won't waive it. They won't want to lose their merchant account.
