Legal Question in Credit and Debt Law in California

credit card debt collector

Hello,

I got a court summons from a credit card debt collector and I'm currently negotiating them and I do have the lump sum of money they are asking me. But they refuse to send me any guarantee letter that they will drop the law suit. We only have verbal agreement so I have a concern they will take the money and still sue me because the court summons expire on may 30th and I don't want them to win the case.

You should be talking to their attorney. Tell them you want them to sign a release or file a Notice of Case Settlement. Then, you will pay them. If they wont do that, they dont really want to settle and you need to file the appropriate response to their lawsuit ASAP.
