Legal Question in Credit and Debt Law in California

Old Credit Card Debt

A company has filed a ''Limited Case'' against me for an old credit card debt that was not paid. The amount I owed was $660 about 4 years ago, now they say it's approximately $2000. Why have they filed this type of case and not a ''Small Claims'' case?

Re: Old Credit Card Debt

A company is not allowed to file in small claims court because it has to be represented in court by an attorney. Attorneys are not allowed in small claims. The amount has increased to $2000, I would guess, because of some interesting accounting work by the debt collector, i.e., interest and collection fees. You have 30 days to answer the complaint, I would speak with an attorney asap.

Yours truly,

Bryan

Re: Old Credit Card Debt

There are limits on filing small claims court cases. If this is a debt collector then they probably filed this way because they cannot keep filing these cases in small claims court.

You should at least consult with an attorney about the process.
