Legal Question in Credit and Debt Law in California
Credit card debt and garnishment question
My father has credit card debt with two cards. The min. payment is $350/month. He has become too ill to work. Diagnosed with terminal Cancer at 79. He had to cease his search for employment. His only income at this time is Soc.Sec.Retirement, $1323/month. He is filing for State Disability income which I understand he qualifies for. He has had to move into an Assisted Living home at $2500/month. Can the credit card companies garnish or collect against his income stated above? As you can see with no savings and only the income stated above, I will need to pick up the balance owed to the home. He can no longer afford to pay on the credit cards. Should I contact them and make them aware of the situation? He has about six months to live according to the Doctors. I am okay paying for his home care, but not excited or really able to pay his credit cards off. I look forward to your answer.

Re: Credit card debt and garnishment question
You need to apply for medi-Cal assistance and the creditor may not attach social security income. I would not notify the creditor. Let them keep trying to chase the wind.
