Legal Question in Credit and Debt Law in California

Old Credit Card Debt

Credit card from major store with exwife, I got the debt in divorce, forgot about it, now they have sent me to a collection agency after 9 years, have not used card since 1990, they claim I made a $50 payment a year ago, which I did not and now the collection agency is sueing me for the debt plus attorney fees. Am I still liable after all this time? Do I have any rights?

Re: Old Credit Card Debt

yes, you definitely have rights herein. the statute of limitations for contractual issues, which your alleged credit card debt is in fact, is 4 years in the state of california. thus, you would not necessarily be liable for the alleged balance owed now mentioned in the "suit" from a procedural law standpoint, especially if you have not made any payments "confirming" the debt within the last year, as is also alleged by your creditor. you definitely can effectively/efficiently fight this and win, in our out of court with proper legal representation here. if you would like further assistance in clearing up this matter asap, contact us directly today.
