Legal Question in Credit and Debt Law in California

Credit Card debt.....

I received a phone call informing me that Discover card has sent my $10,000 debt to an agency for collection.... The person I spoke to told me I have a case number attached to my situation. She told me that Discover would accept a payment of $4,000 to settle the debt. Was this call from a collection agency or an attorney? Will all credit card companies go to court to sue me for payment? Can they afford to with all the hundreds of thousands in this country that owe them? Can and will the company garnish my wages?

Yes, they can and will take you to court. Once they have a judgment, it will last for 10 years, and be renewable for another 10.

How old is the debt. The statute of limitations is 4 years from the date of last activity. If the debt is older than that, they cannot sue.

If you do not ANSWER a complaint, a default judgment may be entered. Wage garnishment is a manner of enforcing a judgment. I defend such cases and ususally save my clients thousands. Call me directly at 16192223504.
