Legal Question in Credit and Debt Law in California

Old Credit Card Debt

Hello,

My wife just received a bill on a credit card from 1987 from a collection agency. The credit card was in her name but her boyfriend at the time ran up a $750 balance. My question is, is she responsible for this balance from 17 years ago on charges that she did not even make? I am not sure if there is a statute of limitations.

Although she has no proof that she did not make the purchases, i.e., receipts, I just believe her that she did not make the purchases.

Thanks for the help.

Re: Old Credit Card Debt

The statute of limitations is 4 years. Depending on what they stated in the letter, you may have a cause of action against the collection agency for violation of collection abuse laws.
