It could be a federal offense if done in another state or using lines of communication across the States (mail or wire fraud). However, it is generally prosecuted under State law as either a misdemeanor or a felony depending on the amount and other factors as determined by the district attorney filing the charges in court. Both Federal and California crimes can be misdemeanors or felonies depending on the crime and some crimes can be charged as either a felony or a misdemeanor in the discretion of the US Attorney or District Attorney hsndling the case.
