Legal Question in Credit and Debt Law in California
Credit Card summons from CC company, not CA
I owe $14,000 on a card to Chase. I am now 5 months behind, I have been trying since day one to work with them. The problem is I don't have any significant cash or assets of my own to pay, but I can borrow $6000 but they did not want to do a settlement for that. They have now sent it to their litigation department and told me a summons is going to be sent to me soon. What should I do? I can't afford their payment plan and they won't accept my $6k. My credit is ruined but I don't want a lawsuit to show up on there, how long do I have? Also, is the summons filed in any California court, or is it in San Diego county (where I am). Also if you are an attorney (preferrably in the north county area) I would like to possibly talk with you about helping me resolve this.

I do defend such lawsuits and at times am able to reduce the total amount owed. It may be as long as a year until you'd have to come to a settlement. I may also be able to negotiate the deal you could not. Contact me directly.
