Legal Question in Credit and Debt Law in California
credit cards
I have been told by several others that there is a statute of limitations on credit card collections, is this true?

Re: credit cards
Yes. The statute of limitation for breach of a written contract is 4 years from the date of the breach. If you become past due and do not may any payments for a period of 4 years thereafter, the debt may be time barred.

There is generally a 4 year limitation of action from the date of the breach. We would need to review your letters of documentation in order to help you. You may have a claim under the Fair Debt Collection Act.
