if the original creditor, i.e.(capital one) charges off the original debt and sells it to a collection agency is the debtor still responsible for that debt?

You may be liable for the debt, but would have a defense if the Statute of Limitations had run. How long ago was the last payment made? - not when the debt was charged off.
