Legal Question in Credit and Debt Law in California
Credit reporting on a settled account
In 6/00 my husband had 2 credit card accounts with a major bank chargedoff for non-payment.
In 6/02 he paid one in settlement to collection agency.
In 10/03 he paid the second also in settlement after we pulled reports and realized it was still not paid.
In 10 and 11/03 he sent letters asking for comfirmation of the dates and amounts regarding the accounts to the bank that issued them because each report shows different info. There was no response.
In 01/04 the accounts which previously were not updated by the credit card company started reporting as ''Currently 120+ Days overdue''. Every month since then they have updated to show the accts are currently delinquent. They have not responded to our letters. They verified the info when we tried to dispute on 3 reports that the information is contradictory. A settled account is considered to be closed/paid & there is no new activity after the charge off date, hence the account was last delinquent up until the payment was made, not after. This would be clear to anyone viewing our reports, based on recent consultations with financial reps.
Last week, said company pulled HARD inquiries on all 3 reports. No permissable purpose, accounts are paid/closed.

With what I can opine from your short message is that the Collection Agency may have violated the Federal and State Fair Debt Collection Act.
