Legal Question in Credit and Debt Law in California

Creditor Garnishment

Is my social security number ''flagged'' throughout the banking industry if I try to open an account with outstanding judgement(s) against me with several creditors; thereby allowing them to levy my assets? My only source of income is my social security check and I don't deposit it for fear of creditors taking it. My creditors are not the IRS--it's credit cards.

Re: Creditor Garnishment

I am not aware of your SSN being "flagged", but I know some banks do run a credit report on new customers. That recently happened a client of mine, but he went to a different bank and was able to open an account.

If you open an account and have your SSN check directly deposited and make no other deposits in the account, the funds will be automatically exempt. You might also consider filing for bankruptcy to get rid of the judgment and not have to worry about this issue anymore.
