Creditor harrassment

I have been contacted by a

collection, trying to collect a bill with

a debtor name similar to mine. I

have sent them proof that I am not

their debtor, yet they have not filed

suit. The defendant caption is a

name similar to mine - the collection

agencies attorney sub-served my

husband and I sent back the

summons and complaint, back to the

attorney and collection agency, but

they have not dismissed their suit.

The police department says no crime

has been committed.

What do I do?

Hire a local attorney to defend you in order to avoid a default judgment against you.

You should have an attorney contact the Plaintiff's attorney with your information to persuade him that you are not the correct defendant. If the case is tried, you may be able to recover costs and legal fees.
