Legal Question in Credit and Debt Law in California

My daughters boyfriend is hiding his truck at my house, he hasn't paid a payment on it in almost 2 years. My wife wants it gone from our house, she say this is considered stolen property and we will be responsible if the truck is found at our home. Please advise as to what I should do. Thank You

You should not be involved. Push the truck out of the garage onto the driveway or even better onto the street. Then padlock the garage.

California law allows the lender to seek a writ of possession for the personal property if the lender wants it back. First the lender needs to locate the property (truck). Do you know who the lender is? Call tehm up and ask if they are looking for the "collateral". If not then they could care less. If yes, tell them where it is and they will send out a repossession company to pick it up. The boy friend never needs to know that you gave it up. Tell him that when they traced the truck to your house you had to give it up.

There is no law that makes it stolen or you liable. Still you have every right to be rid of it. Simons' advice is sound.
