Legal Question in Credit and Debt Law in California
debt collection
I am being contacted by a collection agency for a debt that is 10 years old on which I--name removed--cosigned. Can they still try and collect on this debt?

Re: debt collection
If there's no judgment on the debt and the last payment was made more than 4 years ago (and it is not a guaranteed student loan or taxes), they probably are barred from taking legal action. Send them a letter to CEASE AND DESIST and not to call you again.

Re: debt collection
The statute of limitations has probably run. We need to review the collection letter to see if you have a claim under the Fair Debt Collection Act. When was the last payment made. Please call us if you have any questions.
