If a creditor has turned over a debt to a collections agency and the collections agency says that they won't settle for a percentage of the balance and nor will the creditor, could/would the creditor sue for the full amount? Is it likely or common for a creditor to take legal action instead of setteling? Creditor is AMEX

Absolutely! Not only will it sue for the full amount, but interest accrues at the agreed rate, plus it will tack on hefty attorneys' fees, as well.
