Legal Question in Credit and Debt Law in California
can a debt collector sue me?
My wife set up payments w/ a collector for a medical bil that will be 4 years old in Dec. She had to stop paying to make ends meet. We received a letter from an attorney stating that we will be sued for the debt and attorney fees and that MY wages will be attached because we are married. My wife just had a baby and is not back to work yet. Can we really be sued ? They stated that we have 3 days to reply and that any payment arrangement would need a considerable amount up front to show credibility on our part. Please help. Thank you

Re: can a debt collector sue me?
You may have a lawsuit against the attorney under the Federal Fair Debt Collection Act. We need to review the letter. Generally, a collection letter requires 30 days to response. Please call me if you have any other questions.
