we are in default on a bank issued credit card and were served with papers from the court saying it was a notice of case assignment.can they sue us for unsecured credit card debt?

Unless you are in bankruptcy, you can be sued for unpaid debt. It happens more times than you'd want to count. At minimum, make sure to file and serve your responsive pleading within 30 days of service, show up for the scheduled case management conference, and file and serve your form case management statement at least 15 days before the conference.
