Legal Question in Credit and Debt Law in California

Default on R.V. that is a primary residence

My mother and father live in a recreational vehicle full-time. If they default on their loan can the lender repossess the vehicle just like on a car loan?

Their motorhome is registered with the CA DMV and they drive it around regularly.

Are there any special notices that the lender is required to send like there are with real property?

Thanks.

The controversies that arise regarding a mobile home as a residence are normally in criminal law, as to whether it is a vehicle or not. It make a difference for searches and seizures.

The fact that they drive it around would indicate more that it is a vehicle which could be reposessed. They would not be able to force your parents from the motor home, but if they leave it parked, it is subject to repossession.

Call the lender, explain any circumstances, and work things out.
