Defaulting on a loan

A person has defaulted on a $50,000 loan to me. What court do I take this to for a judgement and how much does it cost to do this. Is there a way for me to get this done without having to go to CA?

Does the note have any provisions for attorney fees or where disputes will be settled? Any arbitration clauses?

Filing in Superior Court in the county where the debtor lives will be appropriate. An attorney here should be able to do everything, unless a trial ensues.

you go to the court where the defendant lives. attorney fees are negotiable but should not be a lot if you have a signed note.
