Legal Question in Credit and Debt Law in California

Demand for payment of 17 yr old credit card debt + interest

I have received a phone call from CAMCO. They say they bought a debt I had with a credit card company in 1985 & now with accrued interest I owe over $5000.00. They say the debt was sold to other companies over the years & now they want to collect. I filed bankruptcy in CA in 1986 & this debt was listed. I told them that. I got another phone message to call them today saying it is urgent. What should I do?

Federal Law Violation(s)

From what you have written, it is likely that CAMCO has violated the Fair Debt Collection Practices Act, which is a federal law. You should contact an attorney and go over in more details what transpired during the phone calls and what was sent to you in the mail, if anything. I cannot tell you specifically what section of the Act it has violated because you did not provide any details of the phone calls, etc.

You do not owe them anything. If you like you can document their harassing phone calls and hire an attorney to stop the harassment and you may be able to sue them under a federal law that prohibits this sort of activity.

Thank you for your question.

First of all, you don't owe them anything.

Second, they are violating state and Federal collection laws, and could be liable to you for harrassment and emotional distress.

You should fax or send by return receipt a copy of the bankruptcy document listing that particular debt.
