Is Deposit for a new car refundable

I made a deposit to a car dealer for a new car that's not in stock, and I have signed a receipt for that deposit not knowing that it says there that it is non-refundable. The car is finally coming after 5 weeks

and I have changed my mind not to get it anymore.

I have already talked to the dealer and they would not give my deposit back. Can I legally get back my deposit??
