Legal Question in Credit and Debt Law in California

Discover Card cooperation on stolen card.

I am writing on behalf of a friend of mine. She had received a new Discover Card approximately 4 years ago, charged about $700 and then the card was stolen. She reported the card stolen to Discover Card and they said they would close the account. She also told them at the time that she did not want the card and that she would pay what she owed. Some time later she received a call from Discover telling her to pay $2000 that was charged to the card. She informed them that she reported the card stolen and the account was closed. Discover told her that the account was reopened and that cash advances were taken on the account. Several conversations with Discover ensued from there that were so harassing that it left my friend in tears. She moved and then they found her again and the calls and notices started again. In the past 6 months she has been receiving letters from whoever purchased the debt to pay and has also received letters from attorneys as well who say they are willing to help her. I would like to know what kind of recourse she has, if any or what she should do without having to pay attorney fees which she does not have.

I appreciate any advice or information you can give.

Thank you for your time.

Re: Discover Card cooperation on stolen card.

Get an attorney and sue Discover Card. It would help if she has information about when she called the cancel the card, who she talked to, etc., and any documentation. There should be some record of it with Discovery. Get an attorney and have them sort it out.
