Legal Question in Credit and Debt Law in California
Disputing an invalide collection debt
My husband and I are trying to purchase a home. We recently discovered that a medical debt of his was taken to collections and reported on his credit report. The Insurance company advised him several times not to pay this debt due to the contract with the hospital and the Insurance company. Correspondance had gone on for almost a year. We have documents from the health insurance company stating that this debt was not his responsibility. How do we clear this up and get this debt collection removed from his report? Do we have a case to sue the insurance company?
