Legal Question in Credit and Debt Law in California
divorce/school debt
Situation
2 children, parents are divorced joint legal custody x10 years. Current orders divides the unreimbursed medical expenses equally.
Parents are uncooperative with each other, co-parenting has been recommended against.
The children are in High school. Two checks are written in the amount of $113 each on August 2008, for an agenda planners, year books, & student body cards for both of the children. Both checks are returned NSF to the parent that has written the check but nothing is done. January 2009, the 1st semester transcripts are mailed but the parents receive notice there is an outstanding debt owed. When the debt is paid, the transcripts will be forwarded.
The parent that has done no wrongdong sends an email stating that there is no association with the other parent as they are divorced and claims no responsibilities for the debt owed and to send the transcripts to the address on file.
The schools response is both parents are equally responsible for the debt and until the debt is paid, the transcripts will be withheld. Where does this stand legally?
Thanks!

Re: divorce/school debt
This is a good example of a situation where a letter from a lawyer to the school on lawyer letterhead will probably convince them to provide the transcripts.
