Legal Question in Credit and Debt Law in California
I just had emergency surgery that cost me $61,000. I have no health insurance and some of it was forgiven but I still owe $31,000. I don't work, only my husband does and he doesn't make a lot of money. I repay my 7 doctors $10. each a month. They want me to pay more and one is telling me if I don't pay at least $100 to him a month, he will start adding on finance fees. I have many other debts and can't afford more than I pay. I am trying to avoid bankruptcy, what can I do?

You do not want to avoid bankruptcy. Bankruptcy is your friend. There is no way on this earth that you're ever going to be able to come up with $31,000-plus-whatever your other debts are. I can only speculate on why it is you feel you want to avoid bankruptcy, but the bankruptcy laws were created to give honest but unfortunate people a fresh start, and it sounds like you are exactly the kind of good person the bankruptcy laws were intended to protect. You really need to sit down with a bankruptcy attorney, both of you, and bring a list of your assets, debts, income, and expenses. Do not get your legal advice from your creditors or from well-intentioned friends or relatives.
Mr. Stone's advice is sound. This is a dilemma that millions of Americans are facing and, one of these days, Congress will tackle the issue of health care for all. Write a letter to your member of Congress and your senators to detail your story.
