Legal Question in Credit and Debt Law in California
Employer not honoring earnings withholding order
My husbands wages have been garnished twice. The first time we did not keep copies of his checks. We figured about eleven hundred dollars had been collected but when I called the levying officer to see how much money they had recieved I was told that they had not recieved any payment. Now my husbands wages are being garnished again for the same debt. This time we have copies of the checks, which has the amount that is being garnished on them figured in with what else is being withheld(taxes,etc.). Our records show that this time over 2000$ has been withheld. The levying officer has only recieved 1200$. What do we do now?

Re: Employer not honoring earnings withholding order
You have a claim against your husband's employer if he willfully failed to withhold wages on your behalf as long as you had a valid order without any order having more priority than yours.
