Legal Question in Credit and Debt Law in California

Estate Question

My father passed away on 3/20. He left a few credit cards with high balances. There is not ''estate'' or real estate. Only a life insurance policy that goes to me, his only child. The letters from Amex have come asking the estate to make arrangements to pay. My question is am I liable for his debts? Do I have to use my inheritance to pay these? Thanks

Re: Estate Question

I am sorry to hear about your loss. Unless the life insurance proceeds were left you in your capacity as the executor or the trustee of a trust, the money is yours. If there is no estate from which to pay the debt, they the American Express bills are not your problem. To be safe, consult a locat probate/estate planning and have him or her review the beneficiary designation on the insurance policy for more specific advice on your duties to your father's creditors.
