Legal Question in Credit and Debt Law in California

Failure To Pay

I sold a co-worker a truck back in July 2003. She was to make payments to me of 200 per month. So far she has only paid 600.00. I signed the pick slip over to her but I have a signed agreement from her that she would make these payments. Can I reposess the truck? Can I add interest and late fees to the balance?

Re: Failure To Pay

If you had taken a security interest in the truck, you could repossess the truck. It appears, however, that you did not. As a result, you will have to get a judgment against her on your contract, and maybe execute against the truck.
