Legal Question in Credit and Debt Law in California

My father wants to borrow $500. I don't mind loaning him the money, but I can't afford to make it a gift. If I specifically put "loan due on (date)" on the check as purpose, would it help me if it did have to go to court?

Just write out a short loan agreement stating basically the same thing and have him sign it. That's better than notating the check.
