Legal Question in Credit and Debt Law in California

fathers bills

my father who is in a nursing home and is 83 with deminita has a credit card debt from 5 yers ago of $12,000. I have POA and he has no assetts. They keep calling and asking for payment. There is no car, house money, etc. What can I do? His SSI goes to his care.

Have you received any correspondence from the collection agency? Apparently, the statute of limitations has run. You may have a claim under the Fair Debt Collection Act or be able to defend the debt based upon the statute of limitations. Please contact me if you need assistance.
