Legal Question in Credit and Debt Law in California

I fell behind on my credit card payments an i get calls everyday from them telling me that they will

bring an action lawsuit or sommon me to appear in court if i don't pay.

However i have been very candid and patient in telling them that i lost my job and cannot pay at this

time. would they be able to sue me and take me to court?
