I want to file a Sacramento, CA judgement in Georgia.

I obtained a Judgement in Sacramento,CA in 1989 and renewed it in 1999. The Debtor has moved to Georgia and I want to record my Judgement and an Abstract of Judgement in Gwinnett County, GA. What forms will I need? I now live in Las Vegas.

Re: I want to file a Sacramento, CA judgement in Georgia.

You will need do the following (and perhaps more) in order to make your judgment enforceable in Georgia:

1) Get an authenticated copy of the judgment by writing to the Sacramento Co. court that issued the judgment and pay the applicable fees for obtaining the document (if any). If applicable, you might ask the CA court to provide you with a statement regarding the interest rate allowed on your CA judgment. Finally, you should provide the GA court with the citation as to the post-judgment interest rate (10%) (CCP Sec. 685.010).

2) Contact the court in Gwinnett County, GA and ask them how you can obtain a sister-state judgment. You will need to ask them what forms you will need and where you can obtain the forms. The GA courts will likely have a form that is similar in function to that of the CA courts (Something like an application for Entry of Judgment). Obtain that form and fill it out.

3) Ask the Gwinnett court if you also need to fill out a "Notice of Entry" form. This form is used to notify the debtor that you have obtained a GA judgment based on the sister-state judgment.

4) Prepare a judgment form for the court to sign (if required - ask the GA court).

5) File the papers with the GA court. Serve the court-endorsed copies on the debtor. (Again, ask the GA court how many copies to file with them and how many conformed copies you may obtain before you send anything out to them).

When obtaining a sister-state judgment, the rules become more complicated since you are now collecting under the laws of the state of GA. I recommend that you first seek the advice of qualified CA or GA counsel with regard to obtaining your sister-state judgment. Good luck!
