Legal Question in Credit and Debt Law in California
filing ANSWER
I hired an attorney to settle a credit card debt lawsuit. Do I still need to file an ANSWER within the 30 days from the date I was served with the suit eventhough we are in the process of negotiating this case?

Re: filing ANSWER
Yes, unless there is an agreement, in writing, otherwise. But you should discuss this with your attorney.

Yes, your attorney should file an answer unless he has received a written extension.

Re: filing ANSWER
Unless your attorney has specifically obtained an extension of time to answer to facilitate negotations, your attorney should file an answer on your behalf. Failing to file an answer could result in a default judgment against you.
