Legal Question in Credit and Debt Law in California
I filled out a cash advance loan application online, giving them my bank into and SS#. I decided not to get loan as interest they offered was too high. Now I got a phone call from law office saying criminal charges are being brought against me for not paying a 300 dollar loan from a California cash advance company. I never got any money but they say I need to show up in CA with a lawyer to prove it. What can I do? I live in Delaware, going to CA isn't really an option. This is obviously a scam, but how can I fight it?

Threaten to get a lawyer and sue them for violations of the Unfair Debt Collection Proactices Act. You can also report them to the Dept. of Consumer Affairs.
Ignore such scams. Just hang up the phone and don't answer calls from that number. Don't apply for such loans anymore since they are rip offs and you are just begging to be a victim of such scams by giving them your social security number and other private information. If you get served with court papers then see a lawyer. Only the District Attorney can prosecute a person for a criminal violation so that is just to scare you. It is all illegal anyway but who got time to be dealing with those people desparate to rip off somebody?
