Legal Question in Credit and Debt Law in California
Finance/ Breach of Contract
I financed a vehicle for someone (my name only on the contract) and this person verbally agreed to make the payments. This person also traded his previous car in for the new car and this trade was included on the contract. However, after making payments for a year, this person decides to stop making payments. I cannot find this person and I am unable to contact this person. It has been several months since the last payment was made on the car. What should or can I do? Can I take this person to court or should I talk to the bank? I do not want a repo on my record however I cannot afford to make the payments.

Re: Finance/ Breach of Contract
What should you do? Start making car payments so it doesn't affect your credit. You could then try to take the person to court, but my guess is that they cannot afford to pay. If they could have afforded to pay, they would not have needed you to sign the loan docs.
