Legal Question in Credit and Debt Law in California
How can I find out if Iam being scammed by a caller who states I owe online payday money that was returned in Nov 2008 that my bank statement show no record of amount. This man from India is calling my job 10 -12 times a day for the last 2 1/2 weeks. He refuses to send me anything and says hes with a law underwritting dept. He just want me to send money blindly. He's speaking to everyone at my job and being rude and threathening.

Demand that he immediately stop talking to other people about your personal financial business because he's in violation of the Federal Fair Debt Collection Practices Act and the California Fair Debt Collection Practices Act. He and his collection agency could be liable for big damages for engaging in this type of unlawful behavior. Insist on asking him for his name and company so you can write a letter to demand in writing verification of the debt and to notify them you will not hesitate to file suit against them for his telling other people at work your business. Tell him to cease communication immediately after you got his information. Put all this in writing. If he does not want to tell you his info, you may have to report him to the police for telephone harassment. That should back him off. You might have a lawsuit against them in the future.
