Legal Question in Credit and Debt Law in California

There is a firm called "Porfolio Recovery" keeps calling me for a credit card bill. I have told the person on the phone each time to quit calling. Their response is I need to give them a written notice. I respond that I don't have to.

I have one email correspondence from them from Michigan.

I have four images of their phone calls by caller ID. Three have a 440 (Ohio) area code. Two of them are from the same number. The other is a 205 (Alabama) area code.

Do I have a case?

No, you do not have a case...at least not yet. The debt collector is correct...you need to put the "do not contact" request in writing. If they are calling you at work, telling them that you cannot take calls at work is legally sufficient to stop that particular form of contact.

Send them a letter via certified mail or fax that says "don't contact me" and that should be sufficient.
