Legal Question in Credit and Debt Law in California

Foreclosure

I received a notice of foreclosure. I have tried 3 times by phone and 3 times in writing to contact the loan holder a private party and they refuse to contact me. Two payments to them came back, one time they moved with no forwarding and the second came back as no longer at this address.

Do I have any legal remedies?

Thank you.

Re: Foreclosure

You must first pay all arrearages and other fees contained in the notice of foreclosure. After the loan has been reinstated, you will then need to sue the lender to recover all of the fees and costs you have paid (other than the actual amounts that should have been due under the note and deed of trust).

Re: Foreclosure

You should contact the trustee. If you cannot reach the trustee, please contact our firm and we will try. If all fails, a lawsuit to enjoin the foreclosure will have to be filed. We can assist you. Please contact us at 714 363 0220.
