Legal Question in Credit and Debt Law in California

I found in the court file, papers that a civil lawsuit has been filed against me 13 months ago, apparently they were unable to serve me notice and they filed a declaration of non-service. How long do they have to serve me without filing more documentation with the court. What happens to the suit if they do not serve me?

It's possible that the court or the plaintiff might dismiss the case for lack of prosecution after a while. Depending on whether the statute of limitation will have run, you might then be legally protected from refiling of the lawsuit.
